澳洲Australia property How do you know if Body Corp applies. | S


在澳大利亚 The pool at of an IP needs to be resurfaced (or so the pool doctor says), the cost was estimated to be $10K ($10,000), after recoverying from my impresssion of a cat coughing up a fur ball, it just seems far too much. Its just a standard poo I need some advice regarding a property purchase. Property - semi-detached house Bedrooms - 2 Condition - average needs internal reno to modernise Street - one of the best in suburb Location - excellent Close to schools - yes Transport - 50m


My wife and I have owned a town house for 8 years. There are two units built on top of each other then our town house which is 2 stories and is built at the end of the two units. Looking at our plans there is a thick black line drawn across them that shows our Town house.There is no part of our property that over laps any part of either unit. On the plans there are two places that show common property, 1 is at the very front of the building that both units look over and the other is where unit1 and unit2's garages are.
One of the owners has decided after a few years that we need Body Corp in place because he wants to sell his unit and also because his solicitor says we need it.
Can any one advise as to who could to give a definative answer as to whether we need BC or not.

I wouldn't be entirely convinced either just because his solicitor says we need it...

Body corporate for 3 properties with only a tiny low maintenance piece of land in common. I don't know the definitive answer, but I suspect you don't need a BC.

How did your neighbour or you buy units if there was no BC at the time?

BTW, a relative in Perth lives in a complex of 3 with minimal common property (side path only). It is strata titled and they have no BC. The only thing they do jointly is have a single insurance policy which they split the premium 3 ways.

How do you deal with a blocked sewer, broken pipe in the outside wall or even a broken window.

Also who pays the insurance on the building as theoretically all the building walls are common property.

I didn't have a body corporate at my last place which was three units on a block. We had common building & liability insurance which one of the owners was in charge of and would just send us the invoice each year asking for 1/3rd. Same with repairs that were required on common property, we just dealt with it between ourselves and all paid 1/3rds when required. Not sure what we would have done though if one of us wanted to be a nuisance and unfair. Fortunately I never had any issues in the time I was there.

If your property is in Victoria and it has common property. BC would have been setup when they were built.

I am sure it is the law. Just do not know how far back.

But a lot of the smaller developments have not been using them activately and no manager in place.

Both of my units have bc's but are not really used.

Mine with 3 on block, all i do is organise the insurance each year and let the other 2 know much to pay. No need to pay the $800 some manager wanted to manage the property.

The owner of unit 1 and myself bought our places off the plan. The guy in the second unit that is pushing for BC purchased a few years later. So JoeD good question, How did he buy then? I will be seeing him on Monday so Iwill ask the question.
Handyandy I'm not sure about the sewer issue but looking at the plans it doesn't appear that we share plumbing with the other two units ours looks completly self contained, there is a brick wall that runs from one side of the block of land to the other and this is what seperates ours from theirs.
Monday we have a meeting with the other owners of the units at the office of a company that does BC, so we will see what they have to say. If we need this I have no problem, but it just seemes to have come out of the blue all of a sudden. Thats why I would like to know who would be the best person to talk to to give a definite answer yes or no.
