If I have funds in a hybrid trust and wish to use some of those funds in another discretionary trust (I'm specifically thinking here of a NZ family trust but I guess an Australian one would be much the same) as RE deposits, what good options are there for doing that?
My funds are initially in a company but I can transfer them to the HDT by buying units. NZ family trusts don't have any such unit feature, from what I've been able to gather, so it seems to me that the only remaining options are either gifting or lending.
I gather the company would have a problem gifting money to a trust, but could one trust gift to another trust (the local HDT would probably be a beneficiary of the NZ one, but that's all)?
If it was a loan, would it have to be at commercial interest rates or could the HDT just effectively give the other trust the money as an interest-free loan?
The problem with it being at commercial interest rates is that the NZ trust would then have 100% borrowed funds, all at commercial rates. I think this would make borrowing from lenders more difficult and means I'd have to have CF+ or neutral properties to avoid losses in that trust.
