He will build new fence he said the old fence is not on boundary line,he will 侵占与我家的交接处 and build new fence,that mean i will lost 50cm width land.
i am not sure the fence should built on the position of existing fence or should built on boundary line by his survoyer?

超过 20 年就应该是你的了吧。都 40 年了，你可以咨询律师保护自己权益了，毕竟 1 米不少呢。

都瞎出主意。Adverse possession 根本不适用于fence. 如果你家房子造在邻居的地上了，12年后，你有“可能”申请成为你的地。这是要上高等法院 来判决的。
楼主的情况，如果对方有surveyor的标注，你就需要把你占的地退出来。fence 基本上都不是精确的在ｂｏｕｎｄａｒｙ.

This is an old doctrine that says, basically, that where a trespasser remains in possession of land for a period of time (usually 15 years and 1 day) then that person may have acquired ownership of the land.
The doctrine prevents someone who has used land for a long period of time, believing it to his/her land, from being ejected by someone who discovers a technical defect relating to the original boundaries.
A typical example is where a fence is incorrectly placed inside the proper boundary of a property. The properties on either side of the boundary may have been sold numerous times before someone discovers the mistake. The owner of the land that has "lost" because of the mistake, cannot now force the owner of the land that has "gained" to move the fence back to the original boundary.

你不信，你就上法院去告吧。旷日持久。你如何证明fence在哪40年。all case is "maybe". 不是一定可以财产反转的。
还是一句话，做人要厚道，占了人家的地，就还给人家。不要总琢磨占便宜

你如果对邻居land suryour的数据质疑，你可以另找一个。如果结果是一致的，你还真不合适反对。
当然你可以耍赖不付费用。邻居也许会告你，这可是有法可依的。
不过做人要厚道，如果别人侵占你的地有50公分那么多，你会怎么做呢？

我不是想占便宜，他只是说他的surveyor 说我们的栅栏位置不对，他就挖了我的地，我没有看到任何数据和报告。因为他知道我不会花钱请另外一个人做。我只是不想吃亏而已，而且我地的宽度确实少了，他说是我那边的邻居几十年前也错了，为什么别人都错了就他对。

你一定要要求对方提供land survey certificate. 上面会清楚标明边界的位置。然后在地上找到这个标记。
