Jailed executives are Chinese, Carr told
BEIJING: The three Australians sentenced to long jail terms in China - Stern Hu, Matthew Ng and Charlotte Chou - were in effect considered Chinese nationals by the Chinese government, despite holding Australian passports, the Foreign Affairs Minister, Bob Carr, said.
Senator Carr, who is on his first official visit as Foreign Affairs Minister after replacing Kevin Rudd, said Chinese officials criticised Australia's military co-operation with the US as an outdated throwback to a Cold War-era alliance.
At a news conference in Beijing yesterday, Senator Carr said he raised "three consular cases" with his Chinese counterpart, the Foreign Minister Yang Jiechi, and was told China did ''not recognise dual nationality".

Asked whether that meant they were considered Chinese nationals and not Australian nationals, Senator Carr responded: "I guess that's right".
Later, on the advice of the ambassador to China, Frances Adamson, he clarified that "the Chinese government does not recognise dual nationality but where Chinese citizens have renounced their Chinese nationality and have entered China on Australian passports we can gain access to them under our bilateral consular agreement".
Chinese nationals must formally apply to renounce their citizenship before taking on a different nationality.
The former Rio Tinto executive Stern Hu, and entrepreneurs Matthew Ng and Charlotte Chou were born in China but took up Australian citizenship.
"Our long-standing position is to seek more transparency in judicial processes in China. We think that's in the interest of more Australian business people moving here and working in China," Senator Carr said.
"The government is very mindful that these cases are being watched by the Australian business community and they are capable of affecting perceptions of the commercial environment in China."
One consular source said there had been growing concerns over apparent differences in the way foreign nationals were treated based on whether they were of ethnic Chinese descent. "It does appear that expatriates of Chinese descent are getting into more trouble," the source said.
Senator Carr said concerns about Australia's "enhanced military relationship" with the US - a reference to the decision to allow US marines to have a presence in Darwin - were raised in three meetings he had yesterday with officials of the Chinese foreign ministry, the military and the Communist Party's international department.
In a meeting with Mr Yang, Senator Carr said he had explained the historical context of the Australia-US relationship and "why they were effectively a cornerstone of Australian policy" and in effect in Australia's "DNA".
"I think their view can be expressed that the time for Cold War alliances have long since past," Senator Carr said of the Chinese response.
Mr Hu was sentenced last year to 10 years' jail after being found guilty of accepting bribes and stealing trade secrets as an executive with Rio Tinto.
In April, Mr Ng was sentenced to 11½ years' jail after his final appeal against bribery and other corporate charges was rejected. In May, Ms Chou was sentenced to eight years' jail for embezzlement relating to a private university she helped found in Guangzhou.

人家米国也是不承认双国籍的： 不管你加入了其他啥国籍，对不起，我都不承认，我只承认你的美国国籍；你想放弃美国国籍，对不起，没门！ 一样的不承认双国籍，米国的做法多好！中国为什么就不能和米国学呢，这样所有的问题都迎刃而解了。而且对那些贪官，对那些在中国犯了法逃出去换个国籍的人永远有追溯权。。。这种双赢的办法为啥就不做呢？

说白了，你去大使馆说要 “申请放弃”，别人会说你是SB，没这业务。
到了国内他们自然要怎么说就怎么说了呗。。。
要你是中国籍，你就是中国籍；不要你，就是澳洲籍，
反正他们觉得他们是土皇帝，他们说什么就算什么。

记得以前看新闻有个拆迁的还拉块布写着这房子是新西兰人民的私有财产，不知道结果怎么样了。

这个放弃中国国籍的讲法是适用于香港和澳门回归，原先那批香港和澳门永久居民的国籍判定，因为香港永久居民和澳门永久居民就是[中国籍]，但有些人是不想要中国籍，要保留他们原有的英籍和葡萄牙籍，那就要办一个退出中国国籍，这是适用那群人的citizenship resolution.
现在，你加入别的国家那就是别的国籍。中国国籍就是自动没有了，根本不用办退出这个手续。但是需要办的是[注销户口]。以前没有在系统里录入，很多人再加入别国国籍后仍旧拿着其实已经失效的中国护照出入中国边境。但这现在这方面要加紧监管了。也就是，只要是外国国籍的，也就是外国人，进中国大陆一定要办有效签证。至于别的国家的领馆是不是提供你领事保护，那是你所加入国籍的那个国家的事情，中国管不着。

既然使领馆给签证就是承认了外籍，中国国籍法规定一旦入外籍就等同自动放弃中国国籍。

不管什么国籍，在一个国家辖区内犯法，当然是要受审的。
媒体大亨默多克1985年加入美国国籍，当时他为了买美国电视台，因为美国电视台持牌人只能是美国国籍，所以他就加入了美国国籍，美国不承认双重国籍，默多克放弃了他的澳洲国籍。新闻集团近年来因为监听监控被起诉触犯英国法律，在英国法律体系下的，默多克照样必须到英国参加听证，这和他拿着哪国国籍没关系。
同理，在美国境内犯罪的，随便什么国籍，一样要受美国法律管制。
