今天老公车上一个人没有系安全带被抓了，当时就给她开了张单，记录了老公车的车牌号。昨天我还给她说过，国内人不爱系安全带，其实警察也不是为了罚款是为了大家的安全，她也说对，今天就没系被抓，哎，以前也没碰到过这样的事情，她还让我问问能申诉吗？我觉得申诉是没戏，只有乖乖认罚。
现在不清楚到底罚不罚司机？老公开了3年车，还从来没有被罚款扣分过。

By law, every person travelling in a passenger vehicle must wear a seatbelt if it is fitted.
There are tough penalties for those who break the law:
driver not wearing seatbelt - driver fined 1.35 penalty units* and three demerit points
passenger over 16 not wearing seatbelt - passenger fined 1.35 penalty units*
passenger under 16 not wearing seatbelt - driver fined 1.65 penalty units* and three demerit points.
In 2009-10, one penalty unit is $116.82.

根据维州ROAD SAFETY ROAD RULES规定 对于罚款 无论是谁没系安全带都要算为两个penalty unit
去年财政年1 penalty unit=$116.82 本财政年涨价了 1 penalty unit=$119.45
此外如果司机没系或者16岁以下的乘客没系 司机要扣3分
回到LZ说的情况 如果这个乘客超过16岁 那么她的罚款应为$239 司机不罚款不扣分

Who is responsible for wearing seatbelts?
If you are the driver, before you drive off make sure:
your own seatbelt is properly adjusted and fastened
any adult passengers have their seatbelts properly adjusted and fastened
Passengers under 16 years of age are restrained as follows:
Children under 12 months must be restrained in a suitable approved child restraint that is properly fastened and adjusted.
Children aged between 12 months and under 16 years should be restrained in a suitable approved child restraint that is properly fastened and adjusted, or occupy a seating position fitted with a suitable seatbelt and wear the seatbelt properly fastened and adjusted.
The type of child restraint that is suitable varies according to a child’s size and weight. For detailed information about choosing child restraints, consult the VicRoads brochure Choosing and Using Restraints (see ‘Resources’).
When buying any seatbelts or child restraints, make sure they are certified as meeting the relevant Australian Standard.
It is safer for children to travel in the back seat.
Who is responsible for wearing seatbelts?
If you are a passenger over 16 years of age make sure your own restraint is properly adjusted and fastened. You must occupy a seating position fitted with a seatbelt, if there is one available.
If you are travelling on a bus or coach where seatbelts are provided, you and any companions must buckle up.
If you are driving a truck you are legally required to wear a seatbelt where one is provided.
If you are buying a new or second hand car, look for models that have a seatbelt reminder system (an audible ‘beep’ as well as a flashing light) for the front and rear seats.
Seatbelt myths
Some people believe they don’t have to wear seatbelts.
Pregnant women should not wear seatbelts. Wrong!
If you are pregnant, wearing a seatbelt will protect you and your baby. The only exception is if you have a letter from your doctor stating you should not wear a seatbelt for medical reasons.
Older drivers need not wear seatbelts. Wrong!
Because they may be physically frail, it is even more important for older drivers to wear seatbelts. If you have difficulty managing your seatbelt because of physical problems, consult an occupational therapist for assistance. A seatbelt positioning device may help.

哎，昨天我也上VICROAD网站看了，是有写要罚司机，不过没找到关于罚多少的规定那部分，现在开始的一个月都要等罚单啦

刚考过交规，上面写着：
如果乘客不系安全带以及7岁以下的孩子没有适当的RESTRAINT， 司机会被罚款，包括扣分。

我来更新一下哈，半年过去了，乘客早已经交了罚款，但是司机的罚单一直没来，看来罚不罚也看警察叔叔的心情，也许是看我老公一直开车记录良好？我觉得有时候警察罚款也会参考司机以前的记录的
不管怎样，还是要记得系安全带啊，我听说警察是用个什么红外线的东西测有没有系安全带的，靠眼睛那肯定不靠谱
